This subclass of visas allows the spouse or de-facto partner of an Australian citizen, permanent resident or eligible NZ citizen to live in Australia. It is an application that can be submitted whilst inside or outside of Australia. Processing timeframes are current anywhere from 15 to 22 months. In order for the applicant to qualify they must be married to or in a de-facto (including same sex) relationship with an Australian citizen, Australian permanent resident or eligible NZ citizen.
The Partner visa is processed in two stages with the first stage of the process being the grant of a temporary (subclass 820 or subclass 309) visa. This temporary visa will remain valid until a decision is made on the permanent residency application which can occur approximately two years after the submission of the approved temporary application. The department will send a notice asking you to apply for the permanent (subclass 801 or subclass 100) or the 2nd Stage of your partner visa.
