Subclass 461 Visa Checklist

To support your claims in the Expression of Interest and demonstrate that you meet the eligibility criteria, you will need to provide various documents. Please refer to the Subclass 461 Visa checklist outlined below.

Required Documents for All Applicants

  1. Identity Documents: Include a passport, birth certificate, and any proof of name change (e.g., marriage or divorce certificate).
  2. Marriage or Relationship Evidence: If you have been married, widowed, divorced, or permanently separated, provide supporting documents such as marriage certificates, divorce papers, death certificates, separation documents, or statutory declarations.
  3. Police Clearance Certificates: Submit overseas police certificates from every country where you have lived for a total of 12 months or more in the last 10 years since turning 16, as well as any military service records or discharge papers if you have served in the armed forces.
  4. Photographs: Include recent passport-sized photographs.
  5. Medical Examinations: Provide evidence of completed medical examinations.
  6. Relationship Evidence: Document your relationship status as the partner, child, or step-child of a New Zealand citizen or their partner.

Additional Documents for the Primary Applicant

  • Marriage Certificate: If married, provide your marriage certificate or other documentation that verifies the validity of your marriage in Australia. If you have been in a de facto relationship for over a year, provide evidence of a ‘Genuine and Ongoing Relationship.’
  • 12-Month Relationship Exception: If your relationship is less than 12 months, provide a written explanation detailing why the 12-month requirement should not apply. This could include evidence of a registered relationship with an Australian births, deaths, and marriages agency or an explanation of any compelling and compassionate circumstances.
  • Previous Relationship Documentation: If you have previously been married, widowed, divorced, or permanently separated, provide relevant documents such as divorce certificates, death certificates, separation documents, or statutory declarations.

Additional Documents for the Sponsoring Partner

  1. Identity Documents: Include a passport, birth certificate, and proof of name change (e.g., marriage or divorce certificate).
  2. Relationship Evidence: Provide proof of any previous marriages, widowhood, divorce, or permanent separation through relevant documentation.
  3. Police Clearance Certificate: Submit an Australian Federal Police clearance certificate if currently in Australia.
  4. Visa Eligibility: Evidence that the sponsoring New Zealand citizen holds or is eligible for a Subclass 444 visa.

All documents must be submitted as color PDF files. If any documents are not in English, an authorized translated version must also be provided.
