How the 820 / 801 Process Works

Stage 1: 820 Temporary Partner Visa

The 820 is the temporary stage that allows you to stay in Australia while your permanent partner visa is being assessed.

Stage 2: 801 Permanent Partner Visa

If your relationship is continuing and genuine, you may be granted permanent residence.

You must be in Australia when you apply for the 820 visa. Both visas are decided in Australia, subject to visa conditions.

What is the difference between 820 and 801?

The Subclass 820 is the temporary stage and the Subclass 801 is the permanent stage of the onshore partner visa pathway. Both stages are generally applied for together.

Can I include children in my application?

Eligible dependent children may be included, provided the relevant dependency, identity, custody, health and character evidence is supplied.

What evidence do we need for a partner visa?

Evidence normally covers the financial aspects of the relationship, household arrangements, social recognition, mutual commitment and the history and future of the relationship.

How long does the 820/801 process take?

Processing times vary with application quality, relationship evidence, health and character checks and Department caseloads. The permanent-stage assessment normally occurs after eligibility for that stage arises.

Can I travel outside Australia?

Travel rights depend on the visa you hold at the time. A Bridging Visa A does not permit return after departure, so a Bridging Visa B may be required before travelling.
