CONTRIBUTORY PARENT PERMANENT VISA

This is a permanent residency visa which allows the visa holder (parent/s) to stay indefinitely in Australia with their children. You may be eligible for this visa if you have children residing and settled in Australia and they are Australian citizen, permanent resident or eligible New Zealand citizen.

Contributory Parent Visa – Subclass 143

As this is a permanent resident visa it affords holders the right to live in Australian indefinitely, as well as unrestricted work and study rights. Permanent Residents have access to Medicare benefits and can apply for Australian Citizenship when eligible

WHO IS ELIGIBLE?

This visa is relevant for a parent whose child or stepchild who, at the time the visa application is lodged, is ‘settled’ in Australia. The child should either be an Australian citizen, permanent resident or eligible New Zealand citizen. This means your child must have been lawfully resident in Australia for a reasonable period, normally two years, although a shorter period can be considered for Australian citizen children if there are compelling and compassionate circumstances.

In addition you must be able to demonstrate one of the following:

  • at least half of your children are Australian citizens, Australian permanent residents or eligible New Zealand citizens who are usually resident in Australia
  • you have more children living in Australia as Australian citizens, Australian permanent residents or eligible New Zealand citizens than in any other country

Your partner and other dependent family members may be included in your application provided they satisfy certain requirements.

VISA BENEFITS?

This visa allows you, your accompanying partner and dependent family members to live as permanent residents in Australia.

You can also:

  • work and study in Australia
  • receive subsidized health care through Medicare and the Pharmaceutical Benefits Scheme (PBS)
  • access certain social security payments (subject to waiting periods)
  • be eligible to apply for Australian citizenship (subject to the residency eligibility criteria)
  • sponsor people for permanent residence (subject to waiting periods)

VISA REQUIREMENTS

APPLICANT ELIGIBILITY

Child in Australia

You must be the parent of a child who is settled in Australia and is one of the following:

  • an Australian citizen
  • an Australian permanent resident
  • an eligible New Zealand citizen

Eligible sponsor

You must be sponsored by an eligible sponsor. Usually, your child will sponsor you. If your child is under 18 years you may also be sponsored by one the following:

  • your child’s partner
  • a relative or guardian of your child
  • a relative or guardian of your child’s partner
  • a community organization

Note: From 1 July 2009 de facto relationships which involve a person under the age of 18 years are not recognized for migration purposes.

ASSURANCE OF SUPPORT

You must have a commitment by a person prepared to provide you with an Assurance of Support.

BALANCE OF FAMILY TEST

You must meet the balance of family test.

HEALTH REQUIREMENTS

You, your partner and all dependent family members must meet certain health requirements and will need to undergo a health examination.

CHARACTER REQUIREMENTS

You, your accompanying partner and all dependent family members aged sixteen and above must meet the character requirements.

DEBTS TO THE AUSTRALIAN GOVERNMENT

Before you can be granted this visa, you must repay, or have made arrangements to repay, any outstanding debts to the Australian Government, before a decision can be made on your application.

OUR PROCESS

1. INITIAL CONSULTATION
During our consultation we will assess your eligibility for the 191 visa. We will discuss your circumstances and then inform you of all the requirements and create a strategy for you if you are eligible.
2. DOCUMENT PREPARATION
Once we have determined that you are your parent satisfy the criteria for sponsorship and the 143 visa application then we proceed with collecting the required documentary evidence from you and your parents.
3. SPONSORSHIP APPROVAL
We start preparing your sponsorship application in preparation for lodgement. Together we go over the application and we quality check before lodgement.
4. VISA APPLICATION PREPARATION
Based on all the documents and information provided we prepare the visa application, quality check and make ready for lodgement.
5. VISA APPLICATION LODGMENT
Once the sponsorship application has been approved, we go ahead and lodge the already prepared visa application.
